OVERDRAFT PROTECTION SERVICE TERMS

FOR USING YOUR SAVINGS, MONEY MARKET, OR CHECKING ACCOUNT

I authorize Intrust Bank, N.A. (Bank) to transfer funds to cover any overdraft which may occur in my Checking Account as set forth in this Overdraft Protection Service Terms (Service Terms). My Checking Account is the account designated as the Child account on the Overdraft Protection Service Account Designation. The transfer will be from the account designated as the Parent account on the Overdraft Protection Service Account Designation (Transfer Account). The Transfer Account may be an Intrust savings, money market or checking account.

My Checking Account is overdrawn whenever it does not have sufficient funds available to pay a Transaction presented for payment (“Overdraft” or “Overdrawn”).

After the end of the Business Day posting (as defined in the Terms and Conditions for Your Deposit Accounts), if my Checking Account is Overdrawn, funds in my Transfer Account will be transferred by the Bank to my Checking Account. The transfer will be in the exact amount to bring the Balance in my Checking Account to zero that day. The Bank will not consider my Checking Account to be Overdrawn that day. [For the purposes of these Service Terms, Balance is defined as the amount of funds in my Checking Account after the end of the Business Day posting process. The Balance is determined before any funds are allocated to POS Transactions that remain pending at the end of the posting process. The Balance may not be the same as the balance shown on my account statement.] 

Although all Transactions that were presented that Business Day were paid prior to the transfer, in limited situations some fees may not be subtracted from the Balance in my Checking Account until after the transfer. This may result in an Overdraft in my Checking Account after the transfer has been made. If the amount of the Overdraft is greater than the overdraft threshold (as defined in the Terms and Conditions for Your Deposit Accounts), an Overdraft fee will be charged. The Bank will consider my Checking Account Overdrawn that day.

If the Transfer Account does not have sufficient funds available to cover the Overdraft, resulting in a zero balance in the Transfer Account, the Transfer Account may be automatically closed. If the remaining Overdraft in my Checking Account is greater than the overdraft threshold, the Bank will consider my Checking Account Overdrawn that day and an Overdraft fee may be charged in accordance with the Terms and Conditions for Your Deposit Accounts. The Overdraft fee shall be the amount as set forth on the Personal Accounts Fee Schedule effective on the date of the Overdraft. 

If the Transfer Account does not have sufficient funds available to cover the Overdraft in my Checking Account, the Bank may return Transactions not paid due to insufficient funds. 

I understand that any use of my Checking Account and Transfer Account is subject to the Bank’s Terms and Conditions for Your Deposit Accounts. All terms not defined in these Service Terms shall have the definition as set forth in the Terms and Conditions for Your Deposit Accounts. Additional service fees and activity fees may apply. 

If my Transfer Account is a savings or money market account, the terms of the account limit preauthorized, automatic and telephone transfers or withdrawals from that account to nine (9) per monthly cycle (an approximate four (4) week period, not necessarily a calendar month). If the limit is exceeded or I attempt to exceed the limit, the Bank may refuse to make the transfer and/or reclassify or close my account. A transfer under these Service Terms is considered a preauthorized transfer. 

If I have previously designated more than one Transfer Account, the bank will continue to honor the designation and transfer from each Transfer Account in the order set out on the Overdraft Protection Service Account Designation. Reference to one Transfer Account in these Service Terms shall be read as referring to all accounts designated on the Overdraft Protection Service Account Designation, as applicable. Any change in ownership of the Checking Account or Transfer Account or the closing of any one Transfer Account for any reason shall require a new Overdraft Protection Service Account Designation and only one Transfer Account will be allowed.

The Bank reserves the right to change these Service Terms upon providing notice as required by law or regulation. My use of this Overdraft Protection Service after notice of a change to the Service Terms will constitute my agreement to the changes. The Bank may cancel this Overdraft Protection Service with me or with all customers enrolled in overdraft protection under these Service Terms at any time. The Bank will provide reasonable notice of the cancelation. The Bank shall not be responsible for my checks being returned for reason of the Bank’s failure to make a transfer(s) of funds.

In the event I have designated different Transfer Accounts for overdraft protection at different times, the designation with the most recent date shall be considered controlling.
